Welcome to onecustomhomes.com (the “Site”), operated by The ONE Group LLC d/b/a ONE Builders (“ONE,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Site.
These Terms govern Site use only. Any design, build, or related services are provided under a separate written agreement that will control in the event of a conflict.
1) Privacy
Your use of the Site is also subject to our Privacy Policy, which explains how we collect and use information submitted through contact forms and other features. Please review it carefully before using the Site.
2) Who may use the Site
You must be at least 18 years old and able to enter into a binding contract to use the Site. You agree to comply with all applicable laws when using the Site.
3) Informational content; no professional advice
Content on the Site (including articles, renderings, floor plans, pricing ranges, timelines, checklists, and FAQs) is for general informational purposes only and is not architectural, engineering, legal, tax, or financial advice. Renderings, plans, finishes, dimensions, and specifications are illustrative and may vary due to permitting, site conditions, product availability, and client selections. No statement on the Site is a firm offer or guarantee of price, availability, features, or timeline.
4) Intellectual property & permitted use
All content on the Site—including text, images, logos, designs, and layout—is owned by The ONE Group LLC or licensed to us and is protected by applicable laws. We grant you a limited, non-exclusive, revocable license to access and view the Site for personal, non-commercial use. You may not copy, modify, distribute, frame, scrape, or create derivative works without our prior written permission.
5) User submissions & communications
If you submit inquiries, files, or other materials through the Site (“Submissions”):
- You represent you have the right to share them and that they’re accurate and lawful.
- You grant The ONE Group LLC a non-exclusive, royalty-free license to use Submissions to review, respond, and improve our services.
- By providing your contact information, you consent to receive communications from us (email, phone, or text). You may opt out of marketing communications at any time.
Testimonials, photos of completed work, and client names are used only with permission in accordance with our Privacy Policy and any separate agreement.
6) Prohibited uses
You agree not to: (a) interfere with Site operation or security; (b) attempt to access non-public areas; (c) use bots, scrapers, or similar tools without permission; (d) submit malicious code; (e) infringe third-party rights; or (f) use the Site for unlawful purposes.
7) Third-party links & tools
The Site may reference third-party websites, products, or services (e.g., mapping tools, social media, vendor/manufacturer sites). We are not responsible for third-party content or practices. Use them at your own risk and review their terms and policies.
8) Availability & changes to the Site
We may update, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time; the “Effective date” will reflect the latest version. Continued use after changes means you accept the updated Terms.
9) Disclaimers
The Site is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that content is current, complete, or accurate.
10) Limitation of liability
To the fullest extent permitted by law, The ONE Group LLC and our officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising out of or related to your use of the Site—even if we have been advised of the possibility of such damages. Our total liability for any claim related to the Site will not exceed USD $100.
Some jurisdictions do not allow certain limitations; in those cases, the limitations will apply to the maximum extent permitted by law.
11) Indemnification
You agree to defend, indemnify, and hold harmless The ONE Group LLC and our affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your Submissions, or your violation of these Terms.
12) Governing law; dispute resolution
These Terms are governed by the laws of the State of Illinois, without regard to conflicts of law principles. You agree that any dispute not subject to arbitration (see below) will be brought in the state or federal courts located in Cook County, Illinois, and you consent to their jurisdiction.
13) DMCA & IP complaints
If you believe content on the Site infringes your copyright, please send a notice containing the information required by 17 U.S.C. §512(c)(3) to our designated agent at info@onebuilders.com. We will respond in accordance with the DMCA.
14) International use
We operate the Site from the United States and do not represent that content is appropriate or available in other locations. You are responsible for compliance with local laws.
15) Accessibility
The ONE Group LLC is committed to making onecustomhomes.com accessible to everyone, including people with disabilities. We strive to meet WCAG 2.1 AA guidelines and continually improve user experience. If you have trouble viewing or navigating any part of the Site, or notice content you believe is not fully accessible, please contact us at info@onebuilders.com or 847-350-9590 (relay calls welcome) with “Accessibility” in the subject line and the page URL and description of the issue. Please note that some third-party content (e.g., maps, videos, social embeds) is outside our control; however, we encourage those providers to offer accessible options.
16) Miscellaneous
If any provision of these Terms is held invalid, the remaining provisions remain in full force and effect. Our failure to enforce any right is not a waiver. These Terms constitute the entire agreement between you and The ONE Group LLC regarding Site use.
